Parcel Division Application

RE: Process for division of lots, parcels or tracts of land pursuant to the following:
1. Land Division Act, Public Act 591 of 1996, as amended by Public Act 87 of 1998
2. Leelanau Township Ordinance – 97-7 – Parcel Division Ordinance

Dear Leelanau Township Property Owner:

Effective March 31, 1997, the Michigan legislature changed the regulations governing the process of land division. There are only TWO scenarios in which a land division does not require Township approval:
1. The requested division produces all resulting parcels of more than 40 acres or the equivalent.
2. The parcel or tract of land being divided was in existence on March 31. 1997, AND results in parcels of 20 acres or more AND are deemed not accessible.

All other divisions of land that do not meet the requirements of the exempt division outlined above REQUIRE approval of Leelanau Township prior to the conveyance of any property.

Parcel Division Applications are available from the Leelanau Township Zoning Administrator’s Office. Approval of the division can only be made if the application is complete, including all attachments and meets all state and local requirements. When the completed application is received the Zoning Administrator and the Assessor will schedule it for review. By law, the Township has 45 days in which to review and respond to the applicant. The 45-day review period will be on the date the completed application is submitted. Upon determination that the application is in compliance with all requirements of the Land Division Act and the Leelanau Township Zoning Ordinance, a new tax identification (parcel) number will be assigned and the applicant will be notified of the approval in writing.

If the application is determined to be incomplete, it will be returned to the applicant with a letter outlining deficiencies. After the applicant has resolved the missing or non-compliance issues, the application may be re-submitted to the township, the 45-day review period will start anew.

Any township approval of an application for a division or property transfer will expire and a new approval will be required after ninety days from the date of the approval, unless the applicant records an instrument of conveyance documenting the division with the Leelanau County Register of Deeds Office, a copy of that recorded document will be forwarded to the township.
