CALL TO ORDER: Meeting Called to order at 6:32 p.m.

 

ROLL CALL: Chair Jerry Bergman, Commissioners: Tom Nixon, Jeff Corbin, Barbara Jameson, Bill Dradolski, Jon Walter and Shirley Wall. Don Gregory arrived at 6:40 p.m..  Doug Periard Absent.  Quorum Established.

 

STAFF PRESENT: Steve Patmore and Rochelle Rollenhagen.

 

GUESTS: There was 1 guest present.

PUBLIC HEARINGS:

45TH NORTH TASTING ROOM:  SITE PLAN REVIEW ON APPLICATION FOR SPECIAL LAND USE PERMIT FOR A WINERY AND TASTING ROOM SUBMITTED BY STEPHEN GROSSNICKLE, GROSSNICKLE FAMILY LMTD PARTNERSHIP, LOCATED AT 8586 E. HORN ROAD, SUTTONS BAY, MI  49682 PROPERTY NUMBER 45-011-018-012-00.

 

 

Patmore indicated that the request was received from 45th N. winery for a tasting room.  Patmore stated that this was a special use in the Agricultural District that must meet certain conditions as outlined in the Ordinance.  Patmore added that the parcel is 100 acres and that the barn was put up in 2006.  The application for tonight is for a tasting room as they have already received their LCC/Winery permit.

 

Nancy Kotting spoke on behalf of the Grossnickles.  She indicated that the new construction would have a minimal environmental impact and the proposed parking lot would be gravel.  The parking provided for 40 parking spaces which was more then the Ordinance required.  The commission asked about the turn around for buses and it was suggested this be detailed on the site plan. 

 

Public Hearing opened and hearing no additional comments the Public hearing was closed at 6:50 p.m.

 

Patmore presented Findings of Fact dated December 5, 2007.  Corbin asked that the architect give a general representation of the size and location and encouraged the Architect to skew the plan and work with the general contours of the land and tree lines.  The commission also encouraged less parking on the site plan. 

 

 

MOVE BY WALTER SUPPORT BY GREGORY TO ACCEPT THE FINDINGS OF FACT AS PRESENTED DATED DECEMBER 5, 2007, SUBJECT TO THE CONDITIONS AS OUTLINED BELOW WITH THE ADDITION OF THE BUS TURN AROUND BEING DETAILED ON THE SITE PLANAND THE ACCURATE REPRESENTATION OF THE WOODLANDS WITH THE SUGGESTION TO REVIEW SITE PLAN OF PARKING AS IT RELATES TO THE BUILDING.  THE COMMISSION ALSO REQUEST FINAL REVIEW OF THE SITE PLAN TO BE DONE BY THE ADMINISTRATION.

 

 

 

            A.  Must obtain any and all required permits or approvals, including Soil Erosion, Health Department, Road Commission, etc, prior to issuance of a Land Use Permit.

 

            B.   Revised Site Plan must be submitted prior to issuance of the Land Use Permit reflecting any changes discussed at the PC meeting.

 

            C.  Must obtain permit for any signage.

 

            D.  Must meet outdoor lighting standards in the Zoning Ordinance.

 

            E.   All utilities must be installed underground

 

      F.   The Site Plan must be modified to show the woodlands, landscaping between the proposed parking lot and the bus turn around.

 

            G.  The Winery shall continue to meet all requirements listed in Article 4.4 (H) – Wineries - of the Suttons Bay Township Zoning Ordinance. These conditions shall be listed on the Special Land Use Permit.

Reports: 

 

Zoning Administrator: Written Report Presented.  Patmore stated that permits are slightly behind last year. Patmore added that the setback violation that has been discussed the last few months has been forwarded to the Township attorney.

 

            Steve stated that the Township has heard a number of complaints from residents on Pebble Beach Drive regarding loud music from the Vineyard Inn. 

 

 Planner:  Rochelle stated that the Township/Village grant request for 23,000 from Coastal Management Grant was granted.  The Smart Growth Assessment Grant will be put to use next month with three meetings to work through the Ten tenants.  These meetings are scheduled for January 10, January 14 and January 25.

Commissioner Comments:  Commissioner Nixon thanked Shirley Wall for her years of service, dedication and stated that she was a “mentor” and always did her homework.
